PLEASE READ CAREFULLY. By using or accessing glutenfreemap.es (the “Site”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Site.

1. Acceptance of Terms

By accessing or using the Site you agree to these Terms and any policies referenced herein (including our Privacy Policy and Cookie Policy). These Terms form a legally binding agreement between you and the Site operator (“we”, “us”, “GlutenFreeMap”).

2. Eligibility

The Site is available to users who can form legally binding contracts. There is no special age restriction in these Terms, but users under any applicable age of majority should review these Terms with a parent or guardian. You may not use the Site in violation of applicable laws.

3. Accounts

  • Account creation: The Site allows users to create accounts. You are responsible for providing accurate account information.
  • User responsibilities: You agree to keep your password and account credentials confidential, not to share your account, and to maintain accurate information. You are responsible for all activities that occur under your account.
  • Security: You must notify us immediately of any unauthorized use of your account.
  • Account deletion & recovery: You may delete your account via account settings (when the feature is available). We may provide a reasonable recovery or grace period for account restoration as part of our standard flows. Data associated with your account will be retained until account deletion as described in our Privacy Policy.
  • Suspension & termination: We may suspend or terminate your account, restrict access, or remove content for violations of these Terms, illegal activity, or at our discretion. Termination does not relieve you of obligations accrued prior to termination.

4. Prohibited Activities

You must not, in connection with the Site:

  • Post illegal content, infringing content, or content that violates others’ rights.
  • Harass, threaten, stalk, or defame other users.
  • Send spam, unsolicited messages, or engage in deceptive practices.
  • Attempt to gain unauthorized access to the Site, systems, or data.
  • Scrape, mine, or harvest data from the Site (including map data) using automated means.
  • Upload viruses, malware, or malicious code.
  • Circumvent any technical protections or interfere with the Site’s operation.

We may investigate and take legal action against any user who violates these rules.

5. User-Generated Content

  • What you post: You may post reviews, ratings, photos, and other contributions ("User Content"). You are solely responsible for User Content you submit.
  • License to the Site: By submitting User Content you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, copy, modify, publish, distribute, and display your User Content on or in connection with the Site and our promotional activities. This license helps us display contributions in the map and other areas of the Site.
  • Attribution & display: Your display name will be shown alongside your public submissions (e.g., reviews).
  • Removal & moderation: We reserve the right to remove, edit, or refuse to display User Content at our discretion (for example, if it violates these Terms). You may delete your own content via your account where that functionality exists. Note that copies of deleted content may persist in backups or cached/archived copies for a reasonable period.
  • No guarantee of confidentiality: Do not submit sensitive personal information as part of User Content.

6. Intellectual Property

  • Site content: All Site content (text, designs, logos, code, graphics, database structure) is owned or licensed by GlutenFreeMap and protected by copyright, trademark, and other laws.
  • Limited license to users: You may view and interact with the Site for personal, non-commercial use in accordance with these Terms. Any other use requires our prior written permission.
  • Feedback: If you submit feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use such feedback without obligation to you.

7. No E-commerce (currently)

We do not sell products or services through the Site at this time. If e-commerce features are added in the future, we will publish appropriate terms (payments, refunds, shipping, taxes) and update these Terms accordingly.

8. Third-Party Services & Links

The Site uses third-party services (e.g., Leaflet, OpenStreetMap, Vercel, Supabase, Brevo). We are not responsible for third-party content, privacy policies, or practices. Links to external sites do not imply endorsement. You access third-party services at your own risk.

9. Privacy & Cookies

10. Disclaimers — No Warranty

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GLUTENFREEMAP, ITS OWNER, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR AFFILIATES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, LOSS OF DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE SITE, THESE TERMS, OR YOUR USE OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EXCEPT FOR LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER MANDATORY LAW (INCLUDING LIABILITY FOR DEATH OR BODILY INJURY CAUSED BY OUR NEGLIGENCE, LIABILITY ARISING FROM OUR FRAUD OR WILLFUL MISCONDUCT, AND LIABILITY ARISING FROM BREACHES OF APPLICABLE DATA PROTECTION LAWS OR REGULATORY FINES), THE AGGREGATE LIABILITY OF GLUTENFREEMAP FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE SHALL BE LIMITED TO A MAXIMUM OF ONE HUNDRED EUROS (€50).

12. Indemnification

You agree to indemnify, defend, and hold harmless GlutenFreeMap, its owner, affiliates, and their respective officers, agents, and employees from any claims, damages, losses, liabilities, costs, and expenses arising from your violation of these Terms, your User Content, or your violation of applicable law.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Spain. Any dispute arising under or relating to these Terms shall be brought exclusively in the courts of Spain. You and we submit to the personal jurisdiction of those courts.

14. Termination

We may suspend or terminate your access or your account at any time for breach of these Terms or for any other reason at our discretion. Sections dealing with Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and any other provisions intended to survive termination will survive termination.

15. Copyright Infringement (DMCA-style procedure)

If you believe content on the Site infringes your copyright, please submit a notice via our contact page: https://www.glutenfreemap.es/contact. Include identification of the copyrighted work, location of the infringing material, contact information, and a statement under penalty of perjury that the information is accurate.

16. Changes to the Terms

We may modify these Terms at any time. We will post the revised Terms on the Site with an updated effective date. Continued use of the Site after notice of changes constitutes acceptance of the revised Terms.

17. Miscellaneous

  • Severability: If any provision is found unenforceable, the remainder will remain in effect.
  • Waiver: Our failure to enforce any right is not a waiver.
  • Assignment: We may transfer or assign these Terms and our rights without your consent; you may not assign your rights without our consent.
  • Entire agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Site.
